Each local government makes health local laws to protect public health within its district and to facilitate the discharge of the local government’s duties under the Health Act 1911.
Health Local Laws are made under section 342 of the Health Act 1911 in accordance with subdivision 2 of Division 2 of Part 3 of the Local Government Act 1995.
The process requires community notification of the intention to make health local laws and consideration of all submissions received in response to the notification. Amendment local laws must be made using the same process as used for making principal health local laws. Health local laws require the consent of the Executive Director Public Health.
The Local Government Act 1995 requires all local laws to be reviewed within 8 years from the date the local law commenced or from the date the report of the previous review was accepted.
The Environmental Health Directorate will assist local governments making and/or amending health local laws.
